Question by : Does anyone know where we can send a letter of protest about an “appraisal” done on our house?
We recently had an “appraiser” come out to our house for an appraisal. We have a quad level house with 3 bedrooms and 2 bathrooms and a finished basement with laundry room. The guy took pictures of the east side of our house and the garage, which is also on the east side, and labeled one the east side and one the west..he never even went on the west side of our house. He didn’t include a bedroom and a bathroom or our family room and never even went into the basement. He says they can’t count ground level rooms as rooms! WHAT??? They were listed as rooms when we built this house, they are listed as rooms at the County Courthouse and I pay taxes on those “rooms”! He left off half of our house and then charged us $ 375. I am contesting the charge with the credit card company but I want this guy to lose his license. I live in Wichita, Kansas. Can someone help me?

when I started hearing of people burning credit cards in on-line poker sites..I knew this day was coming and paid all of my discretionary debt off a few years ago

Get another job, babysit, house sit, pet sit, buy stuff and sell it for a profit, make stuff (birdhouses, paintings, etc.) and sell it, panhandle.

Chapter 13 is one of the most common consumer bankruptcies today in America together with Chapter 7. These Chapters provide for the efficient payment of miss-managed debts in two different ways. Chapter 13, also known as the wage earners’ plan is in its most basic definition, a restructuring effort of your debts to let your expendable income eventually pay the whole amount of your financial obligations. Before you move on with filing under this, learn first some of Chapter 13 bankruptcy rules.
First of all, if your income less the daily living expenses amounts to zero, you cannot file for Chapter 13. You must have a definite expendable amount every month to settle your accounts with your creditors, though it is only a fraction of what they actually expect from you. Chapter 13 provides for the length of time which your debts are divided into. The longer that is, the better is your chance to manage the repayment scheme.
Do not intentionally refrain yourself from going to the court as this can affect your filing. You will also be not allowed to file for Chapter 13 if you received a credit counseling session from an authorized credit counseling group (one on one or group sessions) 180 days prior your actual filing.
Aside from the expendable income that is expected from you to file for Chapter 13, there are also limits to your incurred secured and non-secured debts. Your unsecured debts must be less than $360,475 and your secured debts less than $1,081,400.
The court would need a lot of financial information from you the moment you decide to file under Chapter 13. Some of these are schedule of your schedule of current income and expenditures, schedule of executory contracts and unexpired leases and last but not the least, statement of financial affairs. You must also submit certificate of credit counseling and debt repayment plan developed from the same counseling. Evidence of payment from employers must also be provided together with the net income statement with possible income and expense increases after filing. These bits of information are all important in the decision of the court to deem you legible to claim bankruptcy under the covering of Chapter 13 provisions.
Needless to say, the court would also need the list of your creditors with the specific nature of their claims (to make sure the debt incurred is not of malicious origin). You must also submit the list of your properties. Chapter 13 does not involve itself to the liquidation process of your assets (as in Chapter 7). But you must comply to this requirement nevertheless. Chapter 13 bankruptcy rules are the foundation of a successful filing of your case. Learn from it and use it as an information resource for decision to file for it or not.

If you’re selling a home, or you’re in the market to buy one, you’re going to cross paths with a home appraiser. People also hire appraisers if they need to estimate taxes on an inherited home, or if they need to set a fair value on property that they intend to lease.
Whether you’re the seller or the buyer, a home appraisal sets a market value on a piece of real property. It allows the seller to make an informed decision whether to invest some money in fixing up the home or listing the property as it is. It informs the buyer of all the property’s characteristics-the things beyond the pretty surfaces. It includes:
* The size of the lot.
* Improvements to the lot, and interests or rights attached to it.
* The size of the house and each of its rooms.
* What material the house is made from, including a description of the exterior and foundation.
* When it was built.
* Each room’s floor and wall coverings.
* Descriptions of the heating system, including air conditioning if applicable.
* Description of the electrical system.
* Description of the plumbing system.
* Description of kitchen appliances or other items such as water softener.
* Description of the garage, basement, and attic, if applicable.
The appraiser begins by walking around the property pretty much the same way you would. Even if you tell him the size of the lot, he still checks it himself. He evaluates the availability of real estate property in the area, improvements on the lot as well as on adjacent lots, the permanence of any investments made, and how popular the location is.
Inside the home, he is especially trained to look for signs that other experts should be brought in. For example, an old breaker box might indicate the need for an electrician. If the area has recently been hit by storms, tornadoes, fires, flooding, or the like, he looks for disaster-specific damage.
He also evaluates real estate activity in the area. Typically, he averages several recent sales of similar homes to obtain an estimated market value. If homes in the area are not selling, he investigates to determine whether this home is similar to those. Any new construction in the area can impact the home’s value.
The appraiser chosen should be licensed, if this is required in your state, and accredited. The appraiser should also be someone familiar with your geographic area. You can check the website of the American Society of Appraisers for a directory of accredited appraisers in your area.
You can hire an appraiser whether you are the buyer or the seller, but for purposes of real estate lending, federal regulations stipulate that the appraiser is hired by the lender. That means if you are the seller you can hire an appraiser, but the final say comes from the lender’s appraiser. The cost is borne by the buyer and is paid at the closing.
If an appraisal has been done by one lender and the mortgage is ultimately serviced by another lender, the original appraisal can be transferred as long as the first lender found it acceptable.

With the recent implementation of the Home Valuation Code or HVCC, the issues surrounding appraisals and those in the lending industry has been viewed and realized. The HVCC has been intended to create solutions that will help appraisers and the consumers involved in the lending process. The HVCC is also a set of rules that will, and should, resolve all the issues concerning lending and appraisal transactions.
Basically, the HVCC includes rules claiming that mortgage brokers or any financial establishments offering mortgage loans can no longer select their own appraisers. In addition to that, mortgage brokers and lenders are prohibited to be included in the appraisal process. While the HVCC has spawned a protesting buzz that seems unjust to those in the mortgage business, it actually aims to provide protection for all consumers and loans are backed up by Fannie Mae and Freddie Mac.
Under the HVCC, lenders will have to work with appraisers or create a unit in their companies to order appraisals. Those who violate the HVCC law will have no backing from Freddie Mac and Fannie Mae. In fact, it was duly stated on the HVCC outline that any appraiser who will be influencing and changing the value of an appraisal will be from a line of certified appraisers.
The HVCC was actually implemented last May 1, 2009 laying down the rules for appraisers, lenders, mortgage brokers, loan officers, and real estate agents which will manage appraisals varyingly.
Other rules that the HVCC has set includes loan officers who are forbidden to order appraisals and should not be engaged with appraiser selection. While a loan officer cannot order an appraisal, a lender could provide the order.
Fannie Mae and Freddie Mac will always be involved in transactions so it is wise to adhere to its rules and lending standards. And yet, every person will be affected by these changes brought on by the HVCC. These will include the sellers, home buyers, loan officers, appraisers, lenders, mortgage brokers, and real estate agents. There will also be delays in the transaction process pertaining to the rules and regulations set by the HVCC.
The possible effects of the HVCC include performing appraisals to unfamiliar territories which could possibly pose risks for appraisers with chances of undervaluing the surrounding properties. Another effect pertains to the indiscriminate selection of appraisers. This means that lenders could be employing inexperienced appraisers or worse, hire appraisers of ill-repute without knowing it.
Furthermore, borrowers may sustain extra costs for new appraisals should a broker settle on another lender. Experienced appraisers may even wind up extracting offers since they realize they will not be paid as much unlike before.

No, chapter 13 bankruptcy law does not require you to give up all your assets. You may have to liquidate some assets in order to pay off part of your debts, but for the most part, your debt will be paid off over time by means of your monthly repayment plan. In addition, chapter 13 bankruptcy law allows for a certain amount of exemptions to your filing.
Is it true that I can’t discharge all of my debts in a chapter 13 bankruptcy?
Yes, it is true that there are types of debts that will survive your bankruptcy. These are mainly tax debts, government fines, child support and student loans.
If I file chapter 13 bankruptcy, will my creditors stop harassing me?
Yes. Once the court notifies your creditors of your bankruptcy, an automatic stay goes into effect that prohibits creditors from any further collection actions against a debtor. This includes lawsuits, wage garnishing and harassing phone calls. Creditors are allowed to object to your chapter 13 bankruptcy in the court-supervised Meeting of Trustees.
If I file chapter 13 bankruptcy, will I lose all my retirement savings?
No, in most cases, retirement savings and IRAs are considered exempt from your bankruptcy filing. Because the exact exemptions differ from state to state, you are best advised to ask your chapter 13 bankruptcy lawyer if your retirement savings will be protected.
I filed for bankruptcy before. Will this prevent me from fling chapter 13 bankruptcy?
This depends on which chapter you filed before, whether you received a discharge in the previous case, and how long ago this happened. Contact your bankruptcy lawyer to examine what your options are.
