Question by : Does anyone know where we can send a letter of protest about an “appraisal” done on our house?
We recently had an “appraiser” come out to our house for an appraisal. We have a quad level house with 3 bedrooms and 2 bathrooms and a finished basement with laundry room. The guy took pictures of the east side of our house and the garage, which is also on the east side, and labeled one the east side and one the west..he never even went on the west side of our house. He didn’t include a bedroom and a bathroom or our family room and never even went into the basement. He says they can’t count ground level rooms as rooms! WHAT??? They were listed as rooms when we built this house, they are listed as rooms at the County Courthouse and I pay taxes on those “rooms”! He left off half of our house and then charged us $ 375. I am contesting the charge with the credit card company but I want this guy to lose his license. I live in Wichita, Kansas. Can someone help me?

Give your answer to this question below!
Question by Russell Scott: How do you know when getting a piece of jewelry appraised, that you are getting the best advice?
And that you can trust the appraiser? Do they write up some kind of proof on a form or ticket of some sort so you will not be scammed? A family friend is getting a divorce and even though it’s considered a “friendly” split, the soon to be ex-husband told his soon to be ex-wife that she could keep the wedding ring and he told her that it was a 1/2 caret perfect diamond with no flaws in it. So she is curious on what it might be worth, but of course she wants good proof and I can’t blame her. Opinions/answers would be greatly appreciated.
***Cleo…that’s a great question concerning if the ex-husband has some paper work on where he got the ring. I will let them know. Thank you so much!
***Rita Rose & Lynn….WOW–Your stories really made me think. I will pass them on to the divorcing friends. Thanks!
***Midnight…thanks…another great point about the serial number.

Go to a few different popular diamond/jewelry stores and get it appraised. If the results are all very similar, then you’re probably getting good information. If not, keep looking until you get enough of the same result.

Article Source: http://www.articlesbase.com/ – Chapter 13 Bankruptcy Rules â All You need to know about Chapter 13
Chapter 13 is one of the most common consumer bankruptcies today in America together with Chapter 7. These Chapters provide for the efficient payment of miss-managed debts in two different ways. Chapter 13, also known as the wage earners’ plan is in its most basic definition, a restructuring effort of your debts to let your expendable income eventually pay the whole amount of your financial obligations. Before you move on with filing under this, learn first some of Chapter 13 bankruptcy rules.
First of all, if your income less the daily living expenses amounts to zero, you cannot file for Chapter 13. You must have a definite expendable amount every month to settle your accounts with your creditors, though it is only a fraction of what they actually expect from you. Chapter 13 provides for the length of time which your debts are divided into. The longer that is, the better is your chance to manage the repayment scheme.
Do not intentionally refrain yourself from going to the court as this can affect your filing. You will also be not allowed to file for Chapter 13 if you received a credit counseling session from an authorized credit counseling group (one on one or group sessions) 180 days prior your actual filing.
Aside from the expendable income that is expected from you to file for Chapter 13, there are also limits to your incurred secured and non-secured debts. Your unsecured debts must be less than $360,475 and your secured debts less than $1,081,400.
The court would need a lot of financial information from you the moment you decide to file under Chapter 13. Some of these are schedule of your schedule of current income and expenditures, schedule of executory contracts and unexpired leases and last but not the least, statement of financial affairs. You must also submit certificate of credit counseling and debt repayment plan developed from the same counseling. Evidence of payment from employers must also be provided together with the net income statement with possible income and expense increases after filing. These bits of information are all important in the decision of the court to deem you legible to claim bankruptcy under the covering of Chapter 13 provisions.
Needless to say, the court would also need the list of your creditors with the specific nature of their claims (to make sure the debt incurred is not of malicious origin). You must also submit the list of your properties. Chapter 13 does not involve itself to the liquidation process of your assets (as in Chapter 7). But you must comply to this requirement nevertheless. Chapter 13 bankruptcy rules are the foundation of a successful filing of your case. Learn from it and use it as an information resource for decision to file for it or not.

What do You spend your Money on?
Have you ever thought about where your money goes? I am sure you have some kind of idea when it comes to what bills are due at what time, etc. However, I am talking on a deeper level. It is pretty easy to split your spending into two categories: Money that is spent on assets (things that increase in value) and money that is spent on expenses (things that will decrease in value). Do you ever wonder how the rich get rich? They spend more of their money on assets than they do on expenses.

If you’re selling a home, or you’re in the market to buy one, you’re going to cross paths with a home appraiser. People also hire appraisers if they need to estimate taxes on an inherited home, or if they need to set a fair value on property that they intend to lease.
Whether you’re the seller or the buyer, a home appraisal sets a market value on a piece of real property. It allows the seller to make an informed decision whether to invest some money in fixing up the home or listing the property as it is. It informs the buyer of all the property’s characteristics-the things beyond the pretty surfaces. It includes:
* The size of the lot.
* Improvements to the lot, and interests or rights attached to it.
* The size of the house and each of its rooms.
* What material the house is made from, including a description of the exterior and foundation.
* When it was built.
* Each room’s floor and wall coverings.
* Descriptions of the heating system, including air conditioning if applicable.
* Description of the electrical system.
* Description of the plumbing system.
* Description of kitchen appliances or other items such as water softener.
* Description of the garage, basement, and attic, if applicable.
The appraiser begins by walking around the property pretty much the same way you would. Even if you tell him the size of the lot, he still checks it himself. He evaluates the availability of real estate property in the area, improvements on the lot as well as on adjacent lots, the permanence of any investments made, and how popular the location is.
Inside the home, he is especially trained to look for signs that other experts should be brought in. For example, an old breaker box might indicate the need for an electrician. If the area has recently been hit by storms, tornadoes, fires, flooding, or the like, he looks for disaster-specific damage.
He also evaluates real estate activity in the area. Typically, he averages several recent sales of similar homes to obtain an estimated market value. If homes in the area are not selling, he investigates to determine whether this home is similar to those. Any new construction in the area can impact the home’s value.
The appraiser chosen should be licensed, if this is required in your state, and accredited. The appraiser should also be someone familiar with your geographic area. You can check the website of the American Society of Appraisers for a directory of accredited appraisers in your area.
You can hire an appraiser whether you are the buyer or the seller, but for purposes of real estate lending, federal regulations stipulate that the appraiser is hired by the lender. That means if you are the seller you can hire an appraiser, but the final say comes from the lender’s appraiser. The cost is borne by the buyer and is paid at the closing.
If an appraisal has been done by one lender and the mortgage is ultimately serviced by another lender, the original appraisal can be transferred as long as the first lender found it acceptable.
Before you hire an appraiser, you might want to consider getting a CMA (Comparable Market Analysis) from a Realtor at Automated Homefinder – your Boulder real estate Specialists.

Article Source: http://www.articlesbase.com/ – Legal information: What you should know before filing chapter 13 bankruptcy
Every person’s situation is unique, and please meet with a bankruptcy attorney in your state to insure that chapter 13 bankruptcy is applicable to your personal situation. The following information is provided for educational purposes only.
In a Chapter 13 bankruptcy, your home will be saved if there are little assets that aren’t exempt from seizure by your creditors and you successfully complete the payment over 3 to 5 years. All other non-exempt properties can be retained by the debtor if the payment plan is completed with success. If the payment plan is not completed, these assets will be sold to compensate creditors, as in Chapter 7 bankruptcy.
What are the implications of a Chapter 13 bankruptcy?
Individuals with steady incomes can pay their debts under the protection and supervision of the U.S. Bankruptcy Court. Since 2005, changes in the bankruptcy law disqualify a lot of people from filing Chapter 7 bankruptcy.
Chapter 13 Eligiblity.
Under the new bankruptcy law, you must receive credit counseling within 180 days before filing for Chapter 13.
You are only eligible if:
1. You will be able to pay your debt obligations. If your income is irregular or low, you may not file Chapter 13.
2. Your secured debts must be less than $1,010,650, and your unsecured debts less than $336,900.
3. You were not discharged under Chapter 7, 11, or 12 within the previous 4 years, or discharged under Chapter 13 within the previous 2 years.
The Chapter 13 Repayment Plan
Your repayment plan must be detailed showing how your disposable income will be used to make payments to the full satisfaction of your debts. The plan may be more conciliatory if the creditors or trustee do not object. Provision for taxes, child support and alimony and other priority claims must be made.
Depending on how much you earn and how much you owe, you may propose a three-year or five-year plan. Your plan will end if you repay all of your debts in full, even if you have not yet arrived at the three- or five-year mark.
If You Can’t Make Chapter 13 Payments
If you can’t complete a Chapter 13 repayment plan the bankruptcy trustee may alter your plan, or the court might allow your debts to be discharged based of hardship grounds. An example of hardship could be a debilitating illness.
Otherwise, you might convert to a Chapter 7 bankruptcy or request the bankruptcy court to dismiss your Chapter 13 bankruptcy case (you still owe your debts, plus whatever interest creditors did not charge while you are under Chapter 13).
Chapter 13 Completion
Once your repayment plan is completed, all remaining debts will be canceled. Before you are a discharged, you must prove that your child support and/or alimony obligations are met and that you have completed a budget counseling course.
In summary Chapter 13 typically extends your time for paying debts. And since over the repayment plan, you’ve shown your effort to pay the best that you can, you are discharged despite repaying less than you owe.

A cheap Chapter 13 bankruptcy attorney may be able to provide you with the help you need to get your finances under control. The economy has been tough on everyone. Some people have gotten into money troubles and the only answer seems to be bankruptcy. Chapter 13 bankruptcy is more of a repayment option than a clean sweep.
Understanding Chapter 13 Bankruptcy
1. Chapter 13 bankruptcy is a chance for you to adjust your debts. You can keep your property and pay off what you owe over a set period of time — usually three to five years. It is set up for those filers with regular income that have the ability to make payments.
2. You and your Chapter 13 attorney will work together to come up with a repayment plan. The repayment may cover all of your debts or only part of your debts. The repayment period cannot be longer than five years.
3. During the Chapter 13 bankruptcy repayment period creditors cannot start or continue any collection efforts.
4. Foreclosure proceedings can be stopped by filing for Chapter 13 bankruptcy. The monthly payments for the mortgage must still be paid on time during the Chapter 13 bankruptcy plan. The process may cure any delinquent payments on the mortgage.
5. Chapter 13 acts as a consolidation loan for debtors. It takes all of the different debts and puts them into a payment plan. A trustee of the court collects the payment and then distributes payments to individual creditors. You will have no direct contact with the companies or people that you own money to that are covered under the Chapter 13 bankruptcy.
6. Chapter 13 will require that you file a list of all of your assets and liabilities, your income and monthly expenses, copies of tax returns, any contracts and also a statement of your financial affairs.
7. You will be required to get credit counseling before filing for bankruptcy. The counseling needs to be completed 180 days before filing.
8. There are fees involved with filing Chapter 13 bankruptcy above those paid to your bankruptcy lawyer. You will be responsible for a case filing and an administrative fee. These fees will need to be paid to the court when the bankruptcy is filed. The court can give permission to pay the fees in installments but those installments have to be paid in full no later than 180 days after the petition is filed.
Finding the right Chapter 13 bankruptcy attorney can be one of the most important steps to get your financial troubles under control. Finances can be one of the biggest causes of stress. Choosing a cheap Chapter 13 bankruptcy attorney that you can trust and that will have your best interests in mind will help make this tough time just a little easier.
